COMMUNITY IMPROVEMENT DISTRICT
PLATTE CITY, MISSOURI
NOTICE IS HEREBY GIVEN THAT:

A. The Platte City Market Center Community Improvement District (the "District"), located in Platte City, Missouri (the "City"), and generally bounded by Kentucky Avenue and Lots 6A and 6C Platte Valley Plaza 11th Plat on the North, Lot 6A Platte Valley Plaza 9th Plat on the East, Lots 1 thru 6, Estates of Platte Valley 1st Plat on the South, and Ensign Hill Drive on the West, including (i) that portion of Kentucky Avenue between Ensign Hill Drive and Highway 92, (ii) that portion of Platte Falls Road between Kentucky Avenue and Northwest Running Horse Road, and (iii) that portion of Northwest Running Horse Road between Highway 92 and Platte Falls Road, in accordance with the Missouri Community Improvement District Act, Sections 67.1401 through 67.1571 of the Revised Statutes of Missouri, is proposing an extension of the existing sales and use tax upon all eligible retail sales within the District for an additional period of five (5) years or until such time as the District is terminated or the expenses of the District are paid. Qualified voters will consist of: (a) such persons who reside within the District and who are registered voters pursuant to the records of the Platte County Board of Elections ("Commission") in Platte County, Missouri, as of the thirtieth day prior to the date of election; or (b) if no such registered voters reside in the District, the owners of real property located within the District pursuant to the tax records of the Platte County Clerk, for real property as of the thirtieth day prior to the date of election.
E. Any person(s) residing within the boundaries of the District shall register to vote with the Commission on or before the thirtieth day prior to the date of the election in order to be a qualified voter for the purposes of the election.
F. The ballot must be returned to the Commission's office in person, or by depositing the ballot in the United State mail addressed to:

INVITATION TO BID

PROJECT: Route N Improvements (J4S1951)
BIDS RECEIVED UNTIL 2:00 PM, Thursday June 3rd, 2010, at Platte City, City Hall, 400 Main Street, Platte City, MO 64079 (the Owner), at which time and place bids will be publicly opened and read aloud.
DESCRIPTION OF WORK: The work consists of removal and replacement of Highway N, or 4th Street, located in Platte City, Missouri. The project begins at Thomas Street and ends 200' past the city limits for an approximate project length of 2800 feet. Improvements include construction of a 24 foot asphalt pavement roadway with curb and gutter, sidewalk and stormwater facilities. Work also includes improvements to existing driveways and intersections.
ALL BIDS: must be in accordance with the Bid Documents and Contract Drawings on file at the office of Bartlett & West, 3110 Karnes Road, Suite 100, St. Joseph, MO 64506; the issuing office. Bids will be received on a unit price basis for the street improvements including any Alternative bid items as described in the Bid Documents. The Owner may select any or all items in each section.

AWARD OF THE CONTRACT will be made on the basis of lowest responsive, responsible evaluated bid. Payment for work under this contract will be made in cash on the basis set forth in the General Conditions. Owner is under no obligation whatsoever to accept the lowest bid and shall consider Bidder's reputation and work history in determining what, if any, bid to accept.

THE CITY OF PLATTE CITY hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

NOTICE TO ALL BIDDERS Missouri Law, 292.675 RSMO, requires the awarded contractor and its subcontractor(s) to provide a ten-hour occupational safety and health administration (OSHA) construction safety program (or a similar program approved by the Missouri Department of Labor and Industrial Relations as a qualified substitute) for their on-site employees (laborers, workmen, drivers, equipment operators, and craftsmen) who have not previously completed such a program and are directly engaged in actual construction of the improvement (or working at a nearby or adjacent facility used for construction of the improvement). The awarded contractor and its subcontractor(s) shall require all such employees to complete this ten-hour program, pursuant to 292.675 RSMO, unless they hold documentation of their prior completion of said program. Penalties for non-compliance include contractor forfeiture to the Missouri Highways and Transportation Commission in the amount of $2,500, plus $100 per contractor and subcontractor employee for each calendar day such employee is employed beyond the elapsed time period for required program completion under 292.675 RSMO.

BID ACCEPTANCE OR REJECTION: Owner reserves the right to reject any or all bids and to waive irregularities therein, including without limitation the rights to reject any or all nonconforming, non-responsive, unbalanced or conditional Bids and to reject the bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder, whether because the Bid is not responsive or the Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by Owner. Owner also reserves the right to waive all informalities not involving price, time or changes in the Work and to negotiate contract terms with the Successful Bidder. All Bidders must agree that such rejection shall be without liability on the part of the Owner for any damage or claim brought by any Bidder because of such rejections, nor shall the Bidders seek any recourse of any kind against the Owner because of such rejections, and the filing of any Bid in response to this invitation shall constitute an agreement of the Bidder to these conditions.
