COGAN ROAD BRIDGE OVER SHORT CREEK

Sealed proposals addressed to “Platte County Commission” and endorsed “Proposal” for replacing the Cogan Road Bridge Over Short Creek, Bridge No. 01400001, Platte County, will be received by the County Commission until 1:30 P.M. (Central Daylight Time), July 16, 2009 at the office of the County Clerk, Platte County Courthouse and at that time will be publicly opened and read.

The proposed work includes: furnishing all labor, equipment, and materials necessary to replace the existing bridge carrying Cogan Road over Short Creek, including removal of the existing single span structure and wing walls; construction of the replacement single span, steel wide flange girder bridge; and construction of excavation, embankment, surfacing, rock blanket, storm drainage system and guardrail at the bridge approaches, all in Platte County, Missouri.

Special Needs: if you have special needs addressed by the Americans with Disabilities Act, please notify Platte County Department of Public Works, at 816-858-2223 at least five (5) working days prior to the bid opening you plan to attend.
The wage rates applicable to this project have been predetermined as required by law and are set forth in the bid proposal. When Federal wage rates are applicable and included, this contract is subject to the “Work Hours Act of 1962” (P.L. 87-581; Stat, 357) and implementing regulations.

All Prime Contractors must be on MoDOT’s Approved Contractor Listing seven (7) days prior to bid opening and the DBE Sub-Contractors must be on the MoDOT / Kansas City Approved DBE list prior to Bidding.

NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on June 16, 2003, a certain Home Equity Conversion Deed of Trust (“Reverse Mortgage” or “the Deed of Trust”) was executed by Rufus Ray Cossey, as Grantor, in favor of Wells Fargo Home Mortgage, Inc, as Grantee, and was recorded on June 24, 2003 at Book 1007 Page 43 in the Office of the Recorder of Deeds of Platte County, Missouri; and

WHEREAS, the Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the Secretary) pursuant to the National Housing Act for the purpose of providing single family housing; and

WHEREAS, the Deed of Trust is now owned by the Secretary pursuant to an Assignment dated October 3, 2007, and recorded on February 15, 2008 at Book 1117 Page 822 in the Office of the Recorder of Deeds of Platte County, Missouri; and

WHEREAS, on or before December 7, 2008, Rufus Ray Cossey moved out of the subject property, at which time the subject property was not the principal residence of at least one surviving borrower, thereby requiring the immediate payment in full of all sums secured by the Reverse Mortgage; and

WHEREAS, no sums due and owing under the Deed of Trust have been paid; and

WHEREAS, the entire amount delinquent as of May 26, 2009, was $113,553.58; and

WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Deed of Trust to be immediately due and payable;

NOW THEREFORE, pursuant to the powers vested in me by the Single Family Mortgage Foreclosure Act of 1994, 12 U.S.C. §3751 et seq., by 24 CFR Part 27, subpart B, and by the Secretary’s designation of me as Foreclosure Commissioner recorded on May 1, 2009 at Book 1139 Page 125 in the Office of the Recorder of Deeds of Platte County, Missouri, notice is hereby given that, on Tuesday, June 30, 2009 at 10:00 a.m. local time, all real and personal property used at or in connection with the following described premises will be sold at public auction to the highest bidder:

The sale will be held at the south door of the Platte County Courthouse, 415 3rd Street, Platte City, Missouri. The Secretary of Housing and Urban Development will bid $115,455.28, plus fees and costs.

There will be no proration of taxes, rents, or other income or liabilities, except that the purchaser will pay, at or before closing, his pro rata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.

When making their bids, all bidders except the Secretary must submit a deposit totaling $11,545.53 in the form of a certified check or cashier's check made out to the Secretary of HUD. Each oral bid need not be accompanied by a deposit. If the successful bid is oral, a deposit of $11,545.53 must be presented before the bidding is closed. The deposit is non-refundable. The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence. This amount, like the bid deposits, must be delivered in the form of a certified or cashier's check. If the Secretary is the high bidder, he need not pay the bid amount in cash. The successful bidder will pay all conveyancing fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment and all other costs associated with the transfer of title. At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.

If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the Foreclosure Commissioner after consultation with the HUD Field Office representative, will be liable to HUD for any costs incurred as a result of such failure. The Commissioner may, at the direction of the HUD Field Office Representative, offer the Property to the second highest bidder for an amount equal to the highest price offered by that bidder

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein. HUD does not guarantee that the property will be vacant. The amount that must be paid if the Mortgage is to be satisfied prior to the scheduled sale is $115,455.28 as of May 26, 2009, plus all other amounts that would be due under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner's attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.

Two public meetings will be held on the proposed Water system improvements for Public Water Supply District #8 of Platte County, Missouri for the purpose of receiving comments and views of interested persons.
The meetings will be held on Saturday, June 6, 2009 at 10:00 AM at the Ridgely Christian Church, 19995 S. Ridgely Rd., Ridgely, Missouri.
The first meeting will be held in order to (1) present and discuss planned water system improvements; (2) receive comments on the environmental impact of the project; and (3) allow the public to assist in identifying valid environmental issues involved in the construction and operation of the proposed project. Immediately following the first meeting, the second meeting will be held to discuss (1) the proposed user charge system; (2) answer any questions that persons might have regarding the proposed user charge system.
