Upon motion of Petitioners and with consent of all other parties, this Court hereby orders:
1. A public hearing be held on the creation and funding of the Tremont Square Transportation District on Friday, January 11, 2013 at 10 a.m. or as shortly thereafter as the Court’s schedule allows, at the Platte County Courthouse, Division 2, 415 3rd Street, Ste. 5, Platte City, MO 64079.
2. within the State of Missouri, that a Petition has been filed asking that, upon voter approval, certain taxes and assessments be imposed for a transportation development district by the name of the "Tremont Square Transportation Development District" (the "District") which is formed for the purpose of developing the following transportation projects and are identified in the Petition on file:
PROJECT 1
Project 1 is the widening of Route 45 to construct an eastbound right turn lane and an eastbound acceleration lane at the entrance of Tremont Square's property ("Right In/Right Out") generally located on the south side Route 45 into the existing shopping center located between North Cosby Avenue and North Chatham Avenue. The entrance will be curbed and will be graded down to the existing parking lot area. Drainage and utility adjustments will be addressed as well as the trail system in the area.
PROJECTS 2 AND 3
Project 2 is the construction of a new Prairie View Road alignment south of the 64th Street Interchange. This improvement will redirect the existing
outer road traffic to North Chatham Avenue. The new road will be a collector width street generally traversing west across undeveloped land to connect with North Chatham Avenue and NW 62nd Terrace at a new roundabout (Project 3). The new road will take the outer road traffic to the proposed improved intersection of Highway 45. This will also eliminate the existing west signal near the interchange and allow for the ramps to be located farther west to alleviate traffic backups. The new road will be curb and guttered with an enclosed storm drainage system. Normal utilities will be installed. The Project 3 roundabout will be a single lane 4 way roundabout. The roundabout will connect Prairie View Road, North Chatham Avenue and NW 62nd Terrace, allowing the distribution of traffic to other areas and relieving traffic from the Highway 45 corridor.
PROJECT 4
Project 4 is the construction of a new detention basin. There is an existing detention basin located where the proposed roundabout (Project 3) at the intersection of the new Prairie View Road and North Chatham Avenue is to be constructed. The new detention basin will be located farther south and east and will be used for the detention of storm water stored in the existing basin and the anticipated new storm water flows into this basin from the properties within the TDD and other surrounding properties. This basin will be constructed on property owned by Tuf Flight Industries, Inc. and will use the natural terrain for the bowl of the basin.
The petition requests voter approval of the following methods of funding the district, which may increase the total taxes imposed within the proposed funding district: a one-half of a one percent to a maximum of one percent tax on the receipts from the sale at retail of all tangible personal property or taxable services at retail within the District if such property and services are subject to taxation by the State of Missouri pursuant to the provisions of Sections 144.010 to 144.525, as amended, except such Sales Tax shall not apply to the sale or use of motor vehicles, trailers, boats or outboard motors nor to all sales of electricity or electrical current, water and gas, natural or artificial, nor to sales of service to telephone subscribers, either local or long distance. The Petitioners desire to seek approval of the qualified voters of the imposition of the sales tax at a rate not to exceed one percent (1.0%) for a period of up to twenty-five (25) years. In addition, Petitioners request the levying of a special assessment as follows:
i. With respect to real property categorized as residential real property (single-family or multi-family) for ad valorem tax purposes under applicable Missouri law (whether or not subject to an exemption from ad valorem taxation on the basis that such real property is not held for private or corporate profit and used exclusively for religious worship, for schools and colleges, for purposes purely charitable, or for veterans' organizations), the Real Property Assessment may be imposed for each period from January 1 through December 31 while the Real Property Assessment is in effect (each an "Assessment Year"), in an annual amount not to exceed the sum of $0.125 per square foot of property used for residential purposes by a rate established from time to time by the Board of Directors of the District, such rate not to exceed Twelve and a Half Cents ($0.125) per square foot of land with respect to any Assessment Year (the "Residential Property Assessment").
ii. With respect to real property categorized as industrial, office commercial or any other commercial property that does not produce taxable sales, for ad valorem tax purposes under applicable Missouri law, and all other real property not included in subclasses (1) and (2) of class 1 within the meaning of Article X, Section 4(b) of the Missouri Constitution, Rev. 2006, as amended (whether or not subject to an exemption from ad valorem taxation on the basis that such real property is not held for private or corporate profit and used exclusively for religious worship, for schools and colleges, for purposes purely charitable, for agricultural and horticultural societies, or for veterans' organizations), the Real Property Assessment may be imposed for each Assessment Year, in an annual amount not to exceed the sum of $0.20 per square foot of property used for non-retail commercial use, such as commercial offices, by a rate established from time to time by the Board of Directors of the District, such rate not to exceed Twenty Cents ($0.20) with respect to any Assessment Year (the "Commercial Office Property Assessment").
A copy of this petition is on file and available at the office of the clerk of the circuit court of Platte County, located at 415 3rd Street, Ste. 5, Platte City, MO 64079. You are notified to join in or file your own petition supporting or answer opposing the creation of the transportation development district and requesting a declaratory judgment, as required by law, no later than Monday, January 7, 2013. You may show cause, if there be any, why such petition is defective or proposed transportation development district or its funding method, as set forth in the petition, is illegal or unconstitutional and should not be submitted for voter approval at a general, primary or special election as directed by this court.

The State has established a maximum dollar request for each funding category.
Activities that are eligible for CDBG funding relate to restoring businesses or communities to operation and activities related to assisting individuals displaced as a result of flood disasters. No displacement of persons will be proposed.
The County is seeking funds to repair the levee within the Bean Lake Levee Association and Platte County Drainage District – Section 2. The total project cost is estimated at $1,067,911. The County will make an application in the amount of $213,582.00 in CDBG funds. The Bean Lake Levee Association and Platte County Drainage District will provide in-kind labor, with the Army Corp of Engineers contributing the remaining funds. The project, if funded, will meet the national objective of an urgent threat to health and safety. All citizens, including those in the targeted area, are encouraged to attend in order to comment on the proposed activities.
