Motorist hurt in pursuit dies
from his injuries

Had been hospitalized since July 2 incident

The innocent motorist who was hurt in a police pursuit crash on Interstate 29 in Platte County earlier this month has died from his injuries.

Benjamin L. Shively, 38, died Saturday night at North Kansas City Hospital, according to the Missouri State Highway Patrol.

Shively, of Overland Park, had suffered what were described as critical injuries in the July 2 crash near Platte City.

The wreck occurred while Platte County Sheriff’s Department deputies were pursuing a reported stolen pickup driven by Justin V. Burkholder, 35, of Kansas City. Burkholder eventually ended up traveling northbound in the southbound lanes of I-29 and collided head-on with Shively’s 2014 Suburban a short distance north of the I-29 and HH interchange.

Shively’s vehicle continued southbound, overturned on the bridge and came to an uncontrolled rest on its top.

Both drivers were pinned in their vehicles. Burkholder died at the scene.

Authorities said Burkholder had a felony probation violation warrant from Wyandotte County,
