Lawsuit vs. employee
is delayed

Former Platte County payroll employee Kendra Montgomery was scheduled to be in Platte County Circuit Court last week but the case was continued until Feb. 11.

According to court records, Bob Shaw, county counselor and attorney Christie Jess, who is representing Montgomery, both agreed to continue the case.

Jess officially filed as Montgomery's attorney last Tuesday.

The county commission on Nov. 30 filed a civil lawsuit against Montgomery alleging that she stole more than $2,200 in unearned pay.

Montgomery told The Landmark last month that she would not comment on the case until after court. Presiding Commissioner Betty Knight and Shaw both have declined to comment about the case or why criminal charges were never pursued by the county commission.

After inquiries by The Landmark, the Platte County Sheriff's Department initiated an investigation that is still ongoing, according to Capt. Frank Hunter.

Although Montgomery will not comment about the case, the hiring of Jess as her attorney is noteworthy. Jess litigates for the Employee Rights Law Firm headed by attorney Mark Jess. Mark Jess last year won a high profile discrimination lawsuit against the city of Kansas City. That case, with a judgment of millions of dollars, was litigated in Platte County Circuit Court.
